The topic of product compliance is a serious issue for companies. Not only since the tightening of market surveillance in July 2021 and in view of the many new legislative proposals in 2023/2024, it offers a multitude of unpleasant surprises and should be at the top of the agenda for manufacturing and distribution companies. At the start of the VDE event series Product Compliance from 360°, Dr. Ulrich Becker, lawyer at CMS Germany, explains what the topic of product compliance is all about and what needs to be taken into account. The basics of product liability and product safety are conveyed, but the consequences are also discussed. In addition to warranty claims and claims for damages from product liability, there is a risk of heavy fines and penalties, as well as unpleasant measures from the market surveillance authorities. And there is also trouble from competitors. What you need to pay attention to in order to make your company crisis-proof is the subject of this introductory event. Ulrich Becker will also place the topics in the context of current legislative proposals (such as the Product Safety Ordinance, Machinery Ordinance or the new Product Liability Directive).

In the further course of the follow-up dates for the VDE event series "Product Compliance viewed from 360°", these basics will be explored step by step. For example, we will deal with marking and labeling issues, with questions of quality assurance and production monitoring, customs, market monitoring, address the topic of AI and discuss what happens if, despite everything, things do not "go well", i.e. a product recall or warning is pending. Using practical examples, we will explain how you must react, how a RAPEX analysis is carried out and how best to communicate with the authorities.

As part of the VDE event series "Product Compliance viewed from 360", Günter Uhl, Managing Director of ProductIP Germany, will provide an insight into the various labeling requirements for products and also provide updates on future regulations such as the digital product passport, QR code or electronic address.

After a product has been developed and qualified, the technical documentation is created, including labels on the packaging and product. During subsequent production at locations that are often distributed globally, it must be ensured that the product corresponds to the qualified and documented status. Risks arise, particularly when purchasing a commercial product, which must be minimized. The LkSG (Supply Chain Due Diligence Act) creates new requirements for monitoring suppliers in the supply chain. And here, too, we offer solutions in connection with due diligence and documentation obligations through supplier audits.

The entire pre-shipment inspection process is digitized using the VDE Inspection Management System (IMS). Inspections can be conveniently booked and managed online. The status of each process can be viewed continuously in real time.

In the presentation, Daniel Röhrs, Managing Director China, will present various options for production monitoring. Dr. Ulrich Becker, lawyer at CMS Germany, will also provide information on the legal framework for production requirements.

A number of different requirements are placed on the placing of electronic and electrical items on the market. The legal minimum requirements are diverse and spread across various horizontal and vertical legal acts.

Not only the Low Voltage Directive 2014/35/EU, the Directive 2014/30/EU on electromagnetic compatibility or the Directive 2014/53/EU for radio equipment must be observed. The chemical requirements of the RoHS Directive 2011/65/EU, the REACH Regulation (EC) 1907/2006 and the POP Regulation (EU) 2019/1021 must also be observed. Last but not least, economic operators must also keep the Directive 2012/19/EU on waste electrical and electronic equipment (WEEE) in mind before placing the item on the market.

A new addition is Regulation (EU) 2023/1542 on batteries and waste batteries, which introduces many new requirements and challenges for companies over a timeline.

Our seminar provides an overview of the diverse (new) requirements and new challenges in the context of electrical items and provides practical advice.
