Product compliance is a topic that companies should take seriously. Not only since market surveillance became stricter in July 2021 it can lead to a multitude of unpleasant surprises and should be at the top of the agenda for manufacturers as well as distributors. As a kick-off to the VDE event series Product Compliance from 360°, Dr. Ulrich Becker, lawyer at CMS Germany, will explain what the topic of product compliance is all about and what should be considered. The event will cover the basics of product liability and product safety, as well as the consequences. In addition to warranty claims and claims for damages arising from product liability, there is the risk of serious fines and penalties, as well as unpleasant actions taken by the market surveillance authorities. Even competitors can make trouble. This introductory event will focus on what you need to be aware of in order to make your company crisis-proof. 

In the following sessions of the VDE event series "Product Compliance viewed from 360°", these basics will be discussed in greater detail step by step. For example, we will deal with marking and labeling questions, with aspects of quality assurance and production monitoring, and we will discuss what happens if, despite everything, things do not "go well", i.e. a product recall or a warning is necessary. Using practical examples, we will explain how you need to react, how a RAPEX analysis is carried out and how best to communicate with the authorities.

The risk assessment in accordance with the implementation decision (EU) 2019/417, addressed to the EU member states, represents a guideline of the EU Commission. It is also a suitable instrument in the field of product compliance crisis management, which economic actors who are responsible for the product should think about and consider actions before and issue occurs.

Authorities are obliged to prepare a RAPEX risk assessment at the latest before making an entry in the Safety Gate: the EU rapid alert system for dangerous non-food products (RAPEX for short). Nevertheless, it is advisable as an economic operator to deal with the mechanisms of this method beforehand, if necessary also to avoid impending recalls.

Finally, this type of risk assessment can also be a valuable and targeted tool in cooperation with market surveillance authorities. The similar approach makes communication between the economic operator and the supervisory authority much easier.

Our seminar places the RAPEX risk assessment in the context of the product liability law product monitoring obligations, the practical market surveillance and at the same time explains their opportunities and risks.
